LEGAL INFORMATION

Article 10 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, states that the provider of information society services must have means enabling both the recipients of the service and the competent bodies to access the following information by electronic means, directly, easily, permanently and free of charge:

TERMS OF USE

Scope, purpose and effect

These provisions (hereinafter referred to as the “TERMS OF USE”), govern the access to and use of the website made available by JASO to Internet Users (hereinafter referred to as the “USER/S”) via the domain https://jaso.com/elevation/es/ (hereinafter referred to as the “WEBSITE”).

Without prejudice to the foregoing, access to certain content and use of some of the services JASO makes available to the USER via the WEBSITE may be subject to certain specific terms (hereinafter referred to as the “SPECIFIC TERMS”) which, as the case may be, will replace, complement and/or amend these TERMS OF USE, prevailing over the latter in case of contradiction. These SPECIFIC TERMS, where applicable, will be available to the USERS on the actual WEBSITE.

Consequently, before accessing the said content and/or using the said services, the USERS must carefully read and, where the case may be, accept the SPECIFIC TERMS that govern them in the version published at the time of the said access and/or use.

JASO reserves the right to make any amendments or updates to the content, to these TERMS OF USE and, where the case may be, to the corresponding SPECIFIC TERMS and, in general, to any of the design components or settings of the WEBSITE, at any time and without prior notice.

The TERMS OF USE included in the last published update of the WEBSITE will take priority, and the terms applicable on each visit will be those published at that time on the WEBSITE itself.

By accessing the WEBSITE, the USER expressly and unreservedly consents to and accepts these TERMS OF USE determining the rules for its use, this acceptance being as valid and effective as any signed written contract entered into. If the USER does not accept these TERMS OF USE in their entirety they will not be authorised to access the WEBSITE.

USER registration and password

If the USER’s registration is required for use of the WEBSITE and/or access to certain content and/or services made available to them by JASO via the same, the USER will be responsible for providing accurate and legal information for such purposes.

By means of the said registration, which will be made as established by JASO at any given time, the USER will be assigned (i) a login identifier, and (ii) a password, enabling them to log in at any time as a registered user of the WEBSITE.

The USER undertakes to make diligent use of the identifier and password assigned to them and will be responsible for their proper custody and confidentiality, undertaking not to make them available to any third parties, either temporarily or permanently, and not to permit access to them by outsiders.

In case of theft, loss or unauthorised access to their identifier and password, the USER will be responsible for notifying JASO of this fact immediately so that it can cancel them. Under no circumstances will JASO be liable for any actions carried out by unauthorised third parties using the USER’s identifier and password until the aforementioned notification by the USER is made.

Financial terms of access and use of the WEBSITE

Unless otherwise stated in the SPECIFIC TERMS, where the case may be, access to the Website and its content is free, except for the cost of connection to the telecommunications network the USER has contracted with their supplier.

Industrial and Intellectual Property Rights

All Industrial and Intellectual Property Rights of the WEBSITE are legally reserved and under no circumstances may their access or use by the USER be considered in any way to be a licence for use or rights granted with regard to any asset whose title or ownership corresponds to JASO and/or any third parties. This reservation of rights extends to both (i) the look and feel and the actual code, design and browsing structure of the WEBSITE, and (ii) all content that may be included and distributed throughout the WEBSITE, in any format, and particularly to any catalogues, programs and display graphics that JASO may include on the WEBSITE.

The inclusion on the WEBSITE of references to trade names, brands, logos or other distinctive trademarks, whether or not they are registered and whether they are owned by JASO or third parties, is subject to prohibition of use unless express consent is obtained from JASO or their rightful owner.

Consequently, the USER may only view and use the content and services made available to them via the WEBSITE for strictly personal and private purposes and providing that it is not for the purpose of carrying out business or professional activity with the said content and/or services.

Decompilation, disassembly, reverse engineering, sublicensing or transmitting in any way, translating or creating derivative works based on the computer programs necessary for the functioning, access and use of the WEBSITE are also prohibited. The USER must refrain in any case from removing, altering, avoiding or manipulating any protection devices or security systems that may be installed in the WEBSITE.

Responsibility and guarantees

Persons using the WEBSITE do so at their own account and risk. By accessing the WEBSITE, the USER undertakes (i) to refrain from any conduct that may be detrimental to the image, interests or rights of JASO or any third parties or which could damage, disable or overload the WEBSITE or prevent its normal use in any way; and (ii) to use it in full compliance with the law and good business practices.

Consequently, the USER will be liable to JASO and/or to third parties for any damage that may be caused as a result of their failure to comply with these obligations.

JASO adopts the security measures it deems appropriate to maintain the correct functioning of the WEBSITE and to detect viruses and harmful components. However, the USER must be aware that the security measures of computer systems on the Internet are not totally reliable and JASO consequently cannot guarantee (i) the continued availability of the content and services included on the WEBSITE; (ii) the absence of errors in the said content or correction of any defect that may occur; (iii) the absence of viruses or other harmful components that could cause alterations to the USER’s computer systems (software and hardware) or to their electronic documents and files contained therein; or (iv) the infallibility of the security measures adopted.

Likewise, JASO reserves the right to partially or totally interrupt the service, temporarily or permanently, in case of any technical changes or breakdowns, providing advance notification if possible via the WEBSITE or via any other means established for this purpose.

LINKS

Linked sites

On the WEBSITE, JASO provides the USER with technical linking devices (such as buttons, links or banners) which may lead them to other websites or portals owned or operated by third parties, over which JASO does not exercise any type of control (hereinafter referred to as the “LINKED SITES”).

The USER must take into account that on using the said linking devices and accessing the LINKED SITES from the WEBSITE, these TERMS OF USE will no longer apply.

JASO has no knowledge of or control over the content and services included in the LINKED SITES, and under no circumstances will the inclusion of access to them via this WEBSITE imply (i) that JASO recommends or approves the content and services hosted on the LINKED SITES; and/or (ii) that any type of relationship, collaboration or dependence exists between JASO and the owner of the LINKED SITE.

Consequently, JASO shall assume no liability whatsoever with regard to the LINKED SITES and will therefore not be liable for their functioning, the content and services hosted on them or the links contained in the said LINKED SITES.

If the USER should become aware of the unlawful or inappropriate nature of the content, services or any other activities carried out via a LINKED SITE, they must notify JASO immediately so that where the case may be it may take the measures it deems appropriate.

Hyperlinks

Establishing hypertext links (hyperlinks) on other websites or web pages is authorised, providing the said links lead to the home page https://jaso.com/elevation/es/ or, where the case may be, to any other internal page of the WEBSITE (deep link) and the corresponding pages appear in a full window under their respective URLs, assuming the total responsibility and risk deriving from establishing the hyperlink to the WEBSITE.

It must not be stated in any way on the website or web page establishing the hyperlink that JASO has authorised the said hyperlink, unless JASO has expressly done so in writing.

If the third party establishing the hyperlink on its website or web page wishes to include the brand, designation, trade name, lettering, logo or any other identifying element owned by JASO and/or referring to the WEBSITE, it must obtain prior express written authorisation from JASO for this purpose.

Without prejudice to the foregoing, it is expressly prohibited to display a page from the website https://jaso.com/elevation/es/ in a window of another website not owned by JASO using the so-called “framing” technique, unless JASO’s express consent has been obtained.

Likewise, it is expressly prohibited to include any type of content disseminated via https://jaso.com/elevation/es/ on any other website or web page other than the WEBSITE using the so-called “in line linking” technique, unless JASO’s express consent has been obtained.

Under no circumstances will establishing a hyperlink in accordance with the aforementioned terms imply the existence of any relationship between JASO and the owner/administrator of the website or web page on which the said hyperlink is established, or JASO’s acceptance or approval of its content and/or services.

In any case, JASO reserves the right to prohibit or disable any hyperlink on the WEBSITE at any time, particularly in cases of illegal activity and/or content on the website or web page on which the said hyperlink is included.

PRIVACY POLICY. PERSONAL DATA PROTECTION

JASO EQUIPOS DE OBRAS Y CONSTRUCCIONES, S.L. undertakes to respect the rights of the users of this Website on processing the personal data they supply, in accordance with the personal data protection laws currently in force.

The contact forms and forms for requesting documentation, subscribing to the newsletter, the private area or other parts of the website where services are provided to the user all require users to supply their personal details in order to manage the service requested. Each online data collection form has a link to the data protection policy, which must be expressly accepted by ticking the corresponding box before the form can be considered filled in and the submission process can be completed.

The content of the data protection policy may be amended to adapt it to any legislative changes occurring or to any criteria or guidelines issued by the supervisory authorities.

Users may exercise their rights of access, rectification, cancellation, opposition, limitation of processing, data portability and opposition to automated individual decisions, by email to jaso@jaso.com or to the aforementioned postal address.

APPLICABLE LEGISLATION AND JURISDICTION

These TERMS OF USE are subject to Spanish law.

For settlement of any dispute that may arise regarding access to the WEBSITE, its content and/or the services JASO makes available to the USER via the WEBSITE, the USER and JASO hereby agree to expressly waive any other general or specific jurisdiction that may correspond to them and expressly submit to the Courts and Tribunals of Tolosa.
